Dr Guard was first registered as a GP in NSW on 8 January 1996 and commenced a solo GP practice at Bowraville in the Nambucca Valley of the Mid North Coast, in 2002. In 2018, Dr Guard moved her practice from Bowraville to Macksville.
Previously, on 16 December 2016, the NSW Civil and Administrative Tribunal (“NCAT”) made a finding of professional misconduct against the doctor and imposed conditions on her registration.
Between 2002 and 2019, Dr Guard was the subject of in excess of 20 complaints.
On 29 May 2019, a further condition was imposed that Dr Guard was not to practise medicine. Between May 2019 and October 2019, Dr Guard provided 38 prescriptions in breach of the practice conditions.
The NCAT found that taken together, the proven unsatisfactory professional conduct of Dr Guard was sufficiently serious to justify an order for suspension or cancellation of Dr Guard’s registration. The most serious breaches related to the backdating of two prescriptions for drugs of addiction.
The NCAT also found that Dr Guard suffers from a mental impairment, condition or disorder that detrimentally affects her ability to practise the profession of medicine or is likely to do so.
