When Doctors Break the Rules Patient Safety is Paramount

A recent decision of the NSW Civil and Administrative Tribunal (NCAT) has shed light on troubling conduct by Sydney-based ENT and facial plastic surgeon, Dr Tobias Pincock. In Health Care Complaints Commission v Pincock [2023], the Tribunal found Dr Pincock guilty of professional misconduct following numerous breaches of strict medical conditions intended to protect patients.

Why am I just hearing about this?

On 2 June 2025, NCAT removed the previous pseudonym order which had, until that date, protected Dr Pincock’s identity.

What Went Wrong?

Dr Pincock had a history of substance use and mental health issues, which led to conditions being placed on his medical registration as early as 2019. These conditions were not punitive. They were put in place to ensure he could continue practising safely while receiving the support he needed—through addiction specialists, drug testing, and medical supervision. But Dr Pincock repeatedly failed to comply.

He:

  • Missed drug tests or provided diluted urine samples.
  • Failed to notify authorities of his medication use.
  • Self-administered restricted drugs without proper prescriptions.
  • Delayed or refused treatment by qualified addiction specialists.

Despite several suspensions and repeated warnings, Dr Pincock continued to breach the faith and trust placed in him by his patients, the public, and the Medical Council of NSW.

Why This Matters

The medical profession requires its members to hold themselves and each other to a high standard of integrity and responsibility. When doctors fail to follow the rules—especially those designed to protect the public from risk—it can have devastating consequences. These aren’t just administrative breaches. They go to the heart of patient safety and professional integrity.

As the Tribunal pointed out, the repeated nature of Dr Pincock’s behaviour showed that he posed “a risk to the health and safety of the public.” The breaches were not just about missed paperwork—they showed a pattern of avoidance and indifference with respect to strict conditions.
