Letters of Administration & Deceased Estates

Being an Administrator of a deceased estate holds significant responsibility. It is important that you meet all of your legal obligations in executing the functions of your appointment. We are here to support you with compassion in carrying out your responsibilities. Our experienced team will provide you with expert guidance and advice to support you in your role as administrator.

A grant of Letters of Administration is a legal document issued by the Court, which appoints an administrator to administer the estate of a deceased person, that is to call in all assets, pay liabilities and distribute the deceased’s assets in accordance with the law in circumstances where the deceased did not hold a Will or the executor cannot act for the deceased.

When granted Letters of Administration, the administrator becomes the deceased’s legal personal representative and will then have the power and authority to deal with the deceased’s estate.

Generally, only persons who are entitled to a share of the estate are considered appropriate applicants to apply for administration.

When you have the responsibility as administrator, you want to know that your lawyer is both experienced and compassionate in dealing with the estate and the beneficiaries.

At The Law Office of Conrad Curry we have over 28 years’ experience in obtaining grants of Letter of Administration in the Supreme Court.

There are very strict formal requirements associated with making an application for a grant of Letters of Administration, including publishing a notice of intention on the part of the Administrator to apply for a grant, making requisite searches and enquires to ascertain the estate assets and liabilities, obtaining the death certificate to prove the deceased’s death, preparing the application to the Court (known as a ‘summons’) together with the formal evidence supporting the application (in the form of an affidavit of Administrator), submitting the application and answering any questions the Court may have in respect of the application (‘requisitions’).

The role of Administrator is very important and significant at law. Administrators have obligations to the deceased estate and to beneficiaries. A breach of those obligations may expose the administrator to liability. That is why it is so important that you retain a solicitor with experience in estate law.

It is important that you seek advice from a highly experienced lawyer. Book via the button below or call us today.
