Robert was in his late 70’s when he was involved in a motorcycle accident in 2019 suffering severe injuries including a fracture of his pelvis, a fracture of his sacrum involving his nerves, a lumbar vertebral fracture, cervical spine fractures, thoracic spine fracture, rib fractures, a foot fracture and a right knee tear.
Robert was not at fault and his significant medical expenses were paid by the CT insurer for the driver at fault. Robert required surgery for his pelvis fractures resulting in the need for external fixation where metal rods were screwed into his bones and exited his body and were attached to a frame on the outside of his body. As a result, he required traction and a cervical collar. He had an extended hospital admission with many complications. He then endured a long period of rehabilitation in a different hospital before he was well enough to return home after which he still required extensive physiotherapy and hydrotherapy.
As a result of the accident Robert suffered significant ongoing disabilities and continues to live with ongoing pain and restriction of movement. Robert before the accident was fit and healthy, able to maintain his own home and enjoyed riding his motorcycle. After the accident, Robert described suddenly feeling like an old man and continues to battle severe anxiety every time he tries to ride a motorcycle. The accident had a profound impact on his life.
As a result, The Law Office of Conrad Curry brought a damages claim against the CTP insurer for non-economic loss. That is, we claimed compensation for Robert for his significant pain and suffering, his loss of enjoyment of life and loss of amenity of life. Robert was entitled to claim damages for non-economic loss as his level of impairment was well over the statutory threshold of 10%.
Robert received a significant sum from the CTP insurer for his non-economic loss at an informal settlement conference. Robert will continue to have his ongoing medical and treatment expenses paid by the CTP insurer for life as long as they are considered reasonable and necessary as a result of the accident.
