Brad
Brad is 25, single and is a qualified mechanic. He has a superannuation account balance and death benefit insurance within his super policy and has a collection of limited-edition Motorcycles. He is in a relationship with Sue and they have just started living together. As the relationship is still young, he wanted to ensure that his super would be left to his mum and dad and then his sister if he were to die unexpectedly.
The Will
Brad met with our Senior Estate Planning Solicitor, Conrad Curry. He was surprised to learn that his partner would have a claim on his superannuation funds if he were to die and they had been living together for two years or had a child as a result of the relationship. He was advised that the best approach was to nominate his estate as the beneficiary by way of binding death nomination and direct the payment of his superannuation to his parents under the Will. This is because it was not possible to make a binding nomination in favour of his parents as they were not dependents.
