Jess
Jess recently went through a divorce with her husband Geoff. They had two young children together. In her will, she had appointed Geoff as her executor and left her entire estate to him. Jess’s Family Law Solicitor advised her to renew her Will to ensure that her wishes would be carried out.
The Will
Jess met with our Senior Estate Planning Solicitor, Conrad Curry. Conrad explained that divorce revokes that part of her Will appointing Geoff as her executor and any gifts that she may have left to him. It was necessary therefore to appoint a new executor to manage her estate affairs and to act as trustee of her of her estate until her children were adults.
Jess appointed her sister, Jennifer as her executor and trustee and left her estate on trust for her children. Jennifer was given the power to invest the estate and to pay for the children’s maintenance, education and advancement in life until they became adults.
Jess is now content in knowing that her assets are protected and that her estate will be looked after as she wishes.
